ntellectual Property Policy

Last Updated: January 7th, 2024

At GoodDiy.com, we are committed to protecting intellectual property (IP) and ensuring compliance with IP laws. This policy explains how we handle allegations of infringement, how IP owners can submit reports, and how content providers can respond to infringement claims. We will remove any content cited for alleged infringement once we receive a valid report that complies with our policies.

1. Reporting Infringement

(1) Who Can Report Infringement
Only the rights owner or an authorized agent with permission from the rights owner can submit an IP infringement report.

(2) Investigation Process
We will review the reported listings or content upon receiving your complaint. Please note, all reports must be made in good faith and sworn under penalty of perjury.

(3) Required Information for Reporting
To submit a report, you must be logged into our Intellectual Property Portal (IP Portal). Please include the following:

  • Specific identification of the IP being infringed (e.g., registration number, written description, link to work, first use/publication date).
  • Nature of infringement (product, packaging, images, text on product page, etc.).
  • List of infringing products (URLs for the affected product detail page).
  • List of infringers.
  • Supporting documentation (such as order IDs for test buys).
  • Contact details (name, address, phone number, email).
  • Any other required information under applicable laws.

(4) Additional Information
We may request further documentation or verification regarding the claimed rights before processing the report.

2. Copyright Infringement Report

(1) Required Information for Copyright Infringement Report
If you are the copyright owner or authorized representative, submit a Notice of Copyright Infringement via the IP Portal, including:

  • Signature of the authorized person acting on behalf of the copyright owner.
  • Identification of copyrighted works (can cover multiple works).
  • Identification of infringing material to be removed or disabled.
  • Contact information (address, telephone, email).
  • A statement confirming your good faith belief that the use of the material is not authorized.
  • A statement confirming the accuracy of the notice under penalty of perjury.
  • Additional documentation as required by relevant laws.

(2) Misrepresentation of Infringement
Submitting false claims of infringement may expose you to liability for damages. If uncertain, seek legal advice before submitting a notice.

(3) Action Taken
Upon acceptance of your report, we will remove the infringing content and take action against the responsible parties. Details of actions taken will not be shared unless publicly disclosed.

(4) Repeat Infringer Policy
We have a strict policy for repeat infringers and may terminate their accounts if deemed necessary.

3. Counter-Notice to Copyright Infringement

(1) If a Content Provider Disagrees
If a content provider believes that the content was removed in error, they can file a Counter-Notice containing:

  • A statement explaining why the removal was a mistake or misidentification.
  • Any required documents under relevant laws.

(2) Action on Counter-Notice
Once we receive a valid counter-notice, we will follow applicable laws to take appropriate action.

4. Withdrawal of Report

The intellectual property owner or their authorized agent can withdraw a report through the IP Portal. The withdrawal request should include:

  • Information identifying the original report.
  • Intellectual property rights previously reported as infringed.
  • Specific material to be withdrawn from the report.

5. False Notices

(1) Rejection of False Reports
We reserve the right to reject reports that are false, fraudulent, incomplete, or submitted in bad faith. We may take action against those who abuse this policy.

(2) Consequences for Misuse
Repeated submission of inaccurate or false notices may lead to the removal of submission privileges.
